How long do I have to file a personal injury claim in Malaysia?
Six years from the date of the accident under the Limitation Act 1953. That's separate from — and longer than — the three-year window to claim from the Motor Insurers' Bureau if the at-fault vehicle was uninsured, so don't wait to act.
What if the driver who hit me had no insurance?
The Motor Insurers' Bureau (MIB) compensates the injury itself — not vehicle or property damage — if you can identify the vehicle involved. It does not cover hit-and-run cases where the vehicle cannot be identified, and a claim must be lodged within three years of the accident.
How is personal injury compensation calculated in Malaysia?
Section 28A of the Civil Law Act 1956 sets a statutory multiplier for loss of future earnings: 16 years' purchase for victims aged 30 or under, and (60 minus age at the time of the accident) divided by 2 for victims aged 31 to 59. Insurance and pension payouts are not deducted from the award.
